Breach of Contract:
A client came to us, through their legal counsel, with an
interesting dilemma. Despite being promised, in contract,
the delivery of a substantial amount of raw material, the
supplier breached that contract by failing to deliver the
required quantities and qualities of product promised.
The failure to receive the product caused our client to
lose sales which had been made, as indicated through
purchase orders through their customers, and the
opportunity to make further sales to those customers and
to be able to expand their customer base.
We were asked not only to quantify the short-term lost
profits through lost sales and lost customer
relationships, but the potential long-term implications to
this business. In the preparation of our report, which
resulted from detailed and thorough analysis, our client
was able to negotiate a significant out-of-court
settlement with the supplier and was able to move on with
the task of rebuilding the business reputation and the
corresponding sales and profits.
