Determination of Appropriate Income for Spousal Support:
A family-law lawyer approached us and asked us to examine
the earnings of the spouse of one of their clients. This
spouse earned income from a complex series of corporate
entities in which our client had a partial interest. We
quantified not only that income which was earned directly
by the individual and was reflected in his personal
income-tax filing documents, but we found adjustments that
were required for non-arm’s length transactions and
personal expenses which were deductible for income tax
purposes but appropriately categorized as income for
spousal- and child-support calculation purposes.
Furthermore, we found not only the retained corporate
earnings in the complex corporate structure, but further
non-arms’ length transactions and personal expenses which
required adjustments to the reported earnings in
determining the appropriate basis for calculating spousal
and child support.
Our client is now being paid the proper spousal and child
support on the basis of her spouses’ true earnings and the
spouse did not successfully hide that income through the
structure of their affairs.
